These Terms and Conditions are an agreement between you and Wailea Australia Pty Ltd (ACN 155 959 229) as trustee for the ACRIS Sales Training Unit Trust (ABN 55 467 291 600), trading as the Association of Professional Builders ("APB", "we", "us" or "our"), of 1/10 Albert Avenue, Broadbeach QLD 4218, Australia.
They apply to your use of this website and to every product or service you buy from APB, whether you buy online, through a payment link we send you, by invoice, by direct debit or by phone.
Your quote, checkout or order confirmation sets out what you are buying, the price, the payment schedule and any start date or term. Everything else is set out in these terms. Clause 13 covers one-to-one coaching and Elite Mentoring.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with a service, you are entitled to cancel your service contract with us, and to a refund for the unused portion or compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
For goods, you are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993 where it applies, or any other law that cannot lawfully be excluded, except to the extent that law allows (see paragraph (d) under Liability and indemnity). Where these terms say that a payment is non-refundable, forfeited or final, that applies when you cancel or change your mind, and does not limit those rights.
This website is owned and operated by APB. We offer this website, including all information, tools and services available from it, to you on the condition that you accept these terms and the policies and notices stated here. APB is located in Australia.
All intellectual property in the content on this website belongs to APB or its affiliates. You obtain no interest in that intellectual property. All content on this website is protected by Australian and international copyright and other intellectual property laws. You may not do anything that interferes with or breaches those laws or the intellectual property rights in the content.
You may download and view content or print a copy of material on this website for your own non-commercial use, provided you do not modify the content in any way (including any copyright notice). All rights not expressly granted in these terms are reserved by APB. Unless expressly stated otherwise, you may not copy or republish anything on this website without the permission of the copyright or trademark owner.
The logos on this website are trademarks of APB. Other trademarks may be displayed from time to time and may belong to third parties. Nothing on this website grants any licence or right to use any logo, trademark or masthead without the express written permission of its owner.
Subject to "Your rights under consumer law" above, and to the extent permitted by law:
(a) APB does not warrant the accuracy of the content on this website. The content is provided "as is" and "as available", and you are responsible for assessing its accuracy and relying on it at your own risk. Content may be changed at APB's discretion and without notice.
(b) APB has no responsibility or liability for any loss or damage you incur, including damage to your software or hardware, arising from your use of or access to this website, subject to paragraph (d).
(c) APB does not warrant that functions on this website, such as hyperlinks, will be uninterrupted or error free, that defects will be corrected, or that this website or the server that makes it available is free of viruses or bugs.
(d) Where a service is not of a kind ordinarily acquired for personal, domestic or household use, APB's liability for a failure to comply with a consumer guarantee is limited, at APB's option, to supplying the service again or paying the cost of having the service supplied again.
(e) You indemnify APB and its affiliated companies, and each of their directors, officers, employees and agents, against any claim, loss or expense arising from your breach of these terms or your unlawful use of this website.
(f) APB and its coaches provide business coaching services only. These services may include general discussions on financial topics such as cash flow management, budgeting and pricing strategies. However, APB is not licensed under the Corporations Act 2001 (Cth) to provide financial product advice and does not hold an Australian Financial Services Licence (AFSL).
Any information we provide is general in nature and is intended solely to support the operational performance of your building company. It does not take into account your personal objectives, financial situation or needs. You should seek advice from a qualified financial adviser, accountant or other licensed professional before making any financial decision or acquiring a financial product.
From time to time APB may introduce clients to third-party service providers, including those offering financial, legal, accounting or insurance services. These introductions are provided for your convenience and are not an endorsement or recommendation. You should carry out your own due diligence before engaging any third party.
APB also operates a rewards program, which may include referral or rebate arrangements with selected third-party providers. Where rebates are received, 80% is passed on directly to eligible clients. The remaining 20% is retained by APB to cover the administrative and banking costs of managing the rewards program. Further details are in clause 7 of the Product Terms below.
(g) The APB Client Portal includes AI coaching tools, which provide guidance and general information to owners of residential building companies. Their responses are based on APB's training materials, templates, checklists and content library, and are not a substitute for personalised coaching or for legal, financial or other professional advice.
APB makes no guarantee about the accuracy, completeness or suitability of the information these tools provide. You remain responsible for the decisions you make based on them, and we recommend speaking with an APB Business Coach or a relevant professional before acting on their suggestions. You agree not to rely solely on them when making critical business, financial or legal decisions.
An AI coaching tool cannot make an offer, promise, refund, discount or other commitment on APB's behalf. Anything one of these tools says about an offer, price, refund or discount binds APB only once APB confirms it to you in writing.
These tools may store your questions to generate responses and improve performance over time. We do not sell your data. We share it only with the service providers that run these tools, and we use industry-standard security to protect it.
(h) The SORCI business valuation and analysis (including the score across the core areas of the business, the priority action list, the personalised plan and the valuation figure) is an indicative estimate produced by an automated model from the information you supply about your building company. APB does not audit, verify or independently confirm any of the figures you provide, and the accuracy of the output depends entirely on the accuracy of your input.
The valuation is not a formal, certified or independent valuation of your business. It is not prepared by a registered valuer, it does not follow any recognised valuation standard, and it has not been prepared with your particular circumstances, objectives or needs in mind. It must not be relied upon for the sale or purchase of a business, for raising or securing finance, for tax, accounting or insurance purposes, for litigation or dispute resolution, or for any shareholder, partnership or succession transaction. Before acting on it you should engage a registered business valuer, your accountant or another appropriately licensed professional.
Where the valuation or analysis is described as having a value in dollars, that figure is our estimate of what a comparable valuation would ordinarily cost if obtained independently. It is indicative only, carries no cash value, cannot be redeemed for cash and cannot be exchanged for other products or services.
The valuation and analysis are produced using automated processing and artificial intelligence. APB makes no guarantee about the accuracy, completeness or suitability of the output, and you remain responsible for any decision you make on the basis of it. Benchmarks, multipliers and market comparisons used in the model are drawn from APB's own research data and from third-party transaction data, and describe general market patterns rather than the price any particular business would achieve.
The analysis and any accompanying commentary are general information only. They are not legal, financial, tax, accounting or insurance advice.
Some content, products and services available through this website may include material from third parties. Links on this website may take you to third-party websites that are not affiliated with us. We do not examine or evaluate their content or accuracy, and we are not responsible for any third-party material or website, or for the products or services of third parties.
We are not liable for any harm or damage related to the purchase or use of goods, services, resources or content, or any other transaction, made in connection with a third-party website. Please review the third party's policies and practices carefully before you engage in any transaction. Complaints, claims, concerns or questions about third-party products should be directed to the third party.
By purchasing a product or service from APB, you agree to the following terms. Each is subject to "Your rights under consumer law" above.
1.1 Stored Payment Methods
You authorise APB to charge any credit card, debit card or bank account you have provided or may provide in the future for:
(a) subscription renewals, instalments, tickets, products or services you purchase;
(b) fees that become payable under these terms (including the chargeback handling fee in clause 1.2); and
(c) any overdue amounts that remain unpaid after their due date.
APB may attempt the charge on your primary payment method first and, if it is unsuccessful, on any other stored method. You will receive notice of each charge attempt.
1.2 Chargeback Handling Fee
If you initiate a chargeback with your card issuer for a valid charge under these terms, and the chargeback is found to be unjustified, you agree to pay APB a chargeback handling fee of USD 75 (or the equivalent in the currency of your purchase). This fee reflects APB's reasonable administrative and merchant costs of responding to the dispute.
The fee does not apply where the chargeback relates to a failure on APB's part, or to an amount you were entitled to have refunded.
1.3 Scope of Application
The chargeback handling fee applies to all products, services, ticketed events, courses, workshops, coaching programs and any other offerings provided by APB, whether or not they are specifically listed in these terms.
1.4 Late Payments
Additional fees and charges may apply if your payment is late (see clause 2).
1.5 Currency
You are charged in the currency shown at checkout or on your invoice. Refunds are paid in the currency, and to the payment method, you used. If that currency is not your own, the amount you receive may differ from the amount originally charged because of exchange rate movements since the date of purchase.
2.1 Default
Your account is in default if any amount remains unpaid 28 days after its due date.
2.2 Late Fee
A late payment fee of AUD 50 (or the equivalent in your invoice currency) will be charged to your account.
2.3 Interest
Interest accrues on overdue amounts at 12% per annum, calculated daily from the due date until paid in full, or at the maximum rate permitted by law, whichever is lower.
2.4 Acceleration
If your account is in default and the overdue amount remains unpaid 14 days after we give you written notice asking you to pay it, all remaining amounts payable under your contract or subscription become immediately due and payable.
2.5 Additional Rights
These rights are in addition to any other rights we have under these terms or at law.
3.1 Definitions
The following definitions apply unless the context requires otherwise:
Group Coaching (formerly Membership) means APB's annual group coaching program. It is an annual subscription service that gives clients access to the APB Group Coaching benefits for 12 months.
Renewal means the date exactly 12 months from the date of purchase on which your Group Coaching subscription is set to renew.
30 Day Money Back Guarantee means the guarantee that applies to a new purchase of Group Coaching (not a renewal) and allows the buyer to request a no-questions-asked refund within 30 days of that purchase.
Payment Plan means paying for Group Coaching in instalments rather than in one payment. A payment plan is not a monthly subscription.
3.2 Group Coaching Terms
(a) Group Coaching is an annual subscription service. By purchasing Group Coaching you agree that your subscription will renew automatically each year and that your nominated payment method will be charged on renewal. We will notify you before your renewal date.
(b) To cancel Group Coaching, notify APB in writing at least two (2) business days before your renewal date. Your access continues until the end of the 12 months you have paid for.
3.3 Payment Plan Terms
(a) Payment plans are not offered for new Group Coaching purchases. This clause applies only to clients who already hold a Group Coaching payment plan.
(b) If you hold a payment plan, you agree to pay each instalment in full when it is due. Group Coaching on a payment plan is not a monthly subscription; it is an annual subscription paid in instalments over a set period.
(c) A payment plan subscription renews automatically 12 months from the purchase date at the upfront price. You may renew on the payment plan option by telling the APB team at least 7 days before your renewal date, so that we can change your subscription plan.
(d) If an instalment is not paid when due, your access to Group Coaching may be suspended until it is paid. Payment plans are not pro rata, and full payment is required for access to Group Coaching.
3.4 Money Back Guarantee Terms
(a) The 30 Day Money Back Guarantee applies to each new purchase of Group Coaching.
(b) It does not apply to renewals or to any other APB product.
(c) To use the guarantee, notify APB in writing within 30 days of your purchase and a full refund will be processed. No reason is required.
(d) A request received after 30 days from the date of purchase is not covered by the guarantee.
(e) The guarantee does not apply to purchases made at live events and exhibitions.
4.1 Definitions
The following definitions apply unless the context requires otherwise:
Workshop means any business workshop purchased from APB, as described at the time of purchase. Group Coaching is covered by clause 3, not by this clause.
Session means any individual one-hour meeting that forms part of a Workshop.
Reschedule means asking to change the dates of the entire four-week Workshop at least seven (7) business days before it starts.
No-show means either of the following: (a) cancelling or asking to change dates less than seven (7) business days before the scheduled start of the Workshop; or (b) not attending any of the scheduled sessions without prior notice.
Satisfaction Guarantee means the guarantee that applies to Workshop purchases and allows participants to request a refund under the conditions in clause 4.3.
4.2 Reschedule & No-Show Terms
(a) If you cannot attend the Workshop, you may reschedule up to two (2) times. Each request must be made in writing at least seven (7) business days before the scheduled start of the Workshop.
(b) Failing to attend the scheduled sessions without notice given under clause 4.2(a) is a no-show. A no-show uses one of your permitted reschedules. If no reschedules remain, the Workshop is treated as completed and no refund or credit is provided for a change of mind.
(c) Participants who miss any session due to unforeseen circumstances will receive a video recording of the missed session within two (2) business days after it. No penalty applies.
4.3 Satisfaction Guarantee Terms
(a) The satisfaction guarantee applies to all Workshop purchases.
(b) The satisfaction guarantee is not a change-of-mind policy. You must attend all four (4) sessions live to use it.
(c) If you are dissatisfied with the Workshop, notify APB in writing at the end of the Workshop to request a refund.
(d) Satisfaction guarantee claims must be made within 24 hours of completing the final session.
(e) Refunds are paid in the currency you paid in (see clause 1.5).
(f) This guarantee is in addition to your rights under consumer law, which are not limited by the time frames in this clause.
4.4 Missed Sessions
(a) Participants who miss a session will receive access to the session recording within two (2) business days after the session.
(b) Access to recordings does not affect eligibility for the satisfaction guarantee, provided all sessions are attended live as set out above.
4.5 Completion Period
(a) From the date of purchase, you have twelve (12) months to participate in and complete the Workshop (the Completion Period).
(b) If the Workshop is not completed within the Completion Period, your entitlement to attend future cohorts, access related materials or receive associated benefits expires. No refunds or credits will be provided unless required by law or agreed by APB in writing.
(c) Reschedules under clause 4.2 do not extend or pause the Completion Period. Placement into future cohorts is subject to availability and must occur within the Completion Period.
(d) APB may determine, acting reasonably, whether the Workshop has been completed in accordance with its requirements.
5.1 Eligibility
(a) The APB Annual Retreat is exclusively for the owners and directors of residential building companies that are clients of APB, and their spouses.
5.2 Payment Terms
(a) The balance of your retreat payment must be paid in full by the due date APB gives you when you book.
(b) A booking with an outstanding balance after that date is treated as cancelled on that date, and clause 5.3 applies.
(c) All APB Annual Retreat payments are subject to GST for Australian companies.
5.3 Refund Policy
(a) The USD 1,000 deposit is non-refundable.
(b) Full refunds are also available if government regulations or restrictions in place at the time of the event prevent you from travelling to or attending the event.
(c) If you cancel for any other reason, the deposit is deducted first, and the following percentages apply to the rest of what you have paid, according to how many days before the event you cancel:
(d) Refund requests outside these terms are subject to APB being able to resell your place at the retreat to another builder.
(e) If APB cancels or postpones the retreat, or changes it materially, you may choose a full refund, including the deposit.
5.4 Waitlist Terms
(a) To join the APB Annual Retreat waitlist you pay a refundable deposit of USD 1,000.
(b) If a room becomes available, you will be offered a place at the retreat on payment of the remaining balance (USD 8,997) within seven days. If you accept, your deposit becomes the non-refundable deposit in clause 5.3(a). If you decline, your deposit will be refunded in full in USD. Builders in Australia, New Zealand and Canada may receive less than their original deposit because of currency movements.
(c) If no room becomes available, your deposit will be refunded to you automatically.
6.1 Payment Terms
(a) Payment for the APB Summit (also called the Professional Builders Summit, or the Summit) is due in full at purchase, unless APB has agreed a payment plan with you in writing.
(b) All Summit payments are subject to GST.
(c) If you are paying by payment plan, the full balance must be paid before the event. If it is not, your booking is treated as cancelled on the date the final payment was due, and clause 6.2 applies.
6.2 Refund Policy
(a) Full refunds are also available if government regulations or restrictions in place at the time of the event prevent you from travelling to or attending the event.
(b) If you cancel for any other reason, the following percentages of your payment are forfeited, according to how many days before the event you cancel:
(c) Refund requests outside these terms are subject to APB being able to resell your place at the Summit to another builder.
(d) If APB cancels or postpones the Summit, or changes it materially, you may choose a full refund.
7.1 Definitions
The following definitions apply unless stated otherwise:
APB Rewards means the agreements listed in the APB Rewards Preferred Partner Directory.
Reward Payment means the amount payable to an APB client for qualifying for an APB Reward.
Preferred Partner means a company with which APB has an agreement, as set out in the APB Rewards Preferred Partner Directory.
7.2 Eligibility
To qualify for Reward Payments each quarter, an APB client must:
(a) be a current client of APB in good standing;
(b) submit the building company's details to the Preferred Partner through the APB Rewards Preferred Partner Directory;
(c) engage the Preferred Partner as a new client or customer (unless stated otherwise) after submitting the enquiry through the APB Rewards Preferred Partner Directory. If the enquiry is not submitted through the Directory before engaging the Preferred Partner, the client is not eligible for Reward Payments; and
(d) begin a paid product or service relationship with the Preferred Partner within 365 days of registering interest through the Directory.
7.3 Reward Payments
(a) After completing the enquiry to the Preferred Partner through the Directory, the client must provide bank account details to APB to receive Reward Payments.
(b) Reward Payments are made to eligible clients (see clause 7.2) four times a year, after the end of each quarter, into the nominated bank account.
(c) Reward Payments are based on the rebates APB collects from the Preferred Partner, as shown in the Preferred Partner's revenue report.
(d) The Reward Payment amount varies for each reward. The Directory sets out the percentage for each one.
(e) If bank details have not been provided when Reward Payments are due, APB will hold the payments until they are provided.
(f) Unpaid rewards expire if a bank account is not nominated within one year of APB receiving the Reward Payment from the Preferred Partner.
(g) Unsettled Reward Payments are forfeited if your subscription is cancelled.
From time to time APB sells products or services not covered by another clause of these Product Terms, including digital products such as recorded masterclasses, on-demand courses and event recordings. The following terms apply to them.
8.1 Refunds
(a) Except where a specific guarantee or refund policy applies, we do not offer refunds if you change your mind, including after a digital product has been made available to you.
(b) This does not limit your rights under the Australian Consumer Law or any other law that cannot be excluded (see "Your rights under consumer law" above). If a product or service has a major failure, you are entitled to a remedy under that law.
8.2 Non-Transferable
(a) Purchases cannot be transferred to other products or services.
8.3 Validity Period
(a) An offer may have a stated validity period. It is the buyer's responsibility to use the offer within that period.
8.4 Competitions and Giveaways
(a) General eligibility. Unless otherwise specified, competitions and giveaways run by APB are open to individuals who meet the entry requirements published for that promotion. Entrants must be 18 years of age or older and must not be employees, contractors, agents or affiliates of APB, or immediate family members of any of them. Competitions are void where prohibited by law.
(b) Entry requirements. Entry conditions may include completing set tasks (such as surveys, photo submissions or form entries), engaging with provided content, or meeting stated deadlines. By submitting any content (including text, images or video), entrants confirm they have the necessary rights or permissions and grant APB a worldwide, royalty-free, non-exclusive licence to use the content for the competition, related marketing and future promotions.
(c) Prizes. Prizes are non-transferable, cannot be redeemed for cash or substituted for other products or services, and may have no retail or resale value unless otherwise specified.
(d) Winner selection. Unless otherwise stated, winners are chosen either by a panel of judges or by random draw, depending on the nature of the competition. Judging criteria or draw mechanics will be disclosed in the competition details. APB's decision is final.
(e) Notification of winners. Winners will be notified using the contact details provided at entry. If a winner cannot be contacted or does not respond within 14 days, APB may select another winner.
(f) General conditions. By participating, entrants agree to these terms. APB may verify eligibility, disqualify any entry that does not comply with these terms, and cancel, amend or suspend a competition if circumstances outside its control arise.
The following terms apply to all APB Client Dinner Events.
9.1 Cancellation and No-Show Terms
Registration for a Client Dinner Event is binding on these conditions:
(a) If you cancel your registration more than 10 days before the dinner, no cancellation fee applies.
(b) If you cancel your registration within 10 days of the dinner, a cancellation fee of AUD 297 (plus GST for Australian companies) is charged per registrant.
(c) If you are registered and do not attend without prior written cancellation, a no-show fee of AUD 297 (plus GST for Australian companies) is charged per registrant who did not attend.
These fees cover the costs incurred for confirmed bookings, catering and venue arrangements.
These terms apply to all APB events, including Workshops, the Retreat, the APB Summit, Client Dinner Events and any live presentation event.
10.1 Consent to being photographed and recorded
(a) APB, and any photographers, videographers and event staff engaged by APB, may take photographs and make video and audio recordings at our events.
(b) By registering for an APB event, and by attending one, you consent to being included in those photographs and recordings, and to any comments you make in a group setting being recorded.
(c) Where you register a guest or an additional attendee, you confirm that you have made them aware of this clause and that they consent to it on the same terms.
10.2 How we use them
(a) You grant APB a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, edit and publish photographs and recordings in which you appear, for marketing and promotional purposes.
(b) This includes our website, our social media channels, email campaigns, printed and digital publications, reports, presentations and advertising.
(c) No fee is payable to you for this use, and APB is under no obligation to use any photograph or recording.
(d) We will not use a photograph or recording in a way that is defamatory, or that implies you endorse a product or service that you have not endorsed.
10.3 If you would rather not appear
(a) You may tell us at any time, before or during an event, that you do not wish to be photographed or recorded, and we will take reasonable steps to exclude you.
(b) You may also ask us to stop using a particular photograph or recording of you. Write to us using the details under Contact Information and we will remove it from material we control within a reasonable time.
(c) We cannot recall material that has already been printed, distributed or shared by third parties.
10.4 Privacy
Photographs and recordings that identify you are personal information. We handle them in accordance with our Privacy Policy.
These terms apply to all event sponsorships with APB, covering Networking Events and Networking and Dinner Events, and clause 11.6 also applies to sponsorship of the APB Summit. They set out your entitlements and obligations as an event sponsor.
11.1 Attendees
(a) Sponsorship includes one attendee per company.
(b) One additional attendee may be approved by APB at an extra cost of $150 (plus GST for Australian companies) for Networking Events, or $297 (plus GST for Australian companies) for Networking and Dinner Events.
(c) Networking and Dinner Events are invoiced in Australian dollars. Networking Events are invoiced in either Australian or United States dollars depending on the event, and the fee in clause 11.1(b) is the same figure in whichever currency applies.
(d) Total attendees must be confirmed, and any request for an additional attendee submitted, at least 14 days before the event.
(e) Invoices must be paid in full before the event.
11.2 Access, Inclusions and Conduct
(a) Sponsors will have unrestricted access to all attendees, both APB clients and non-clients, during the networking hour.
(b) Complimentary drinks and canapés will be provided by APB.
(c) A list of attending companies will be shared with sponsors before the event.
(d) For Networking and Dinner Events, sponsors will be included in a three-course dinner seated with APB clients.
(e) Access under this clause is conditional on the sponsor's attendees complying with these terms, with any reasonable direction given by APB or its staff, and with the rules of the venue.
(f) APB may refuse entry to, or remove from, any event any person whose conduct is, or in APB's reasonable opinion is likely to be, aggressive, belligerent, threatening, intimidating, abusive, harassing or discriminatory, who is unlawfully under the influence of alcohol or any illicit substance, or whose conduct otherwise risks causing distress, offence, injury, damage or disruption to other attendees, to APB staff or to the venue.
(g) APB may exercise this right before an event, including by declining to register a nominated attendee because of that person's previous conduct at an APB event, and may require the sponsor to nominate a substitute attendee.
(h) No refund, credit or compensation is payable where entry is refused or an attendee is removed under this clause, and the refund scale in clause 11.6 does not apply.
11.3 Introductions and Follow-Up
(a) APB may provide post-event introductions by email at the sponsor's request, where appropriate and at APB's discretion.
11.4 Brand Visibility
(a) APB will provide premium logo placement on all event emails and registration pages.
(b) The sponsor's company name will be featured in all event-related social media promotions.
(c) APB will acknowledge the sponsor verbally during the event.
(d) Any professional photography taken at the event will be provided to the sponsor after the event.
11.5 Display Guidelines
(a) One pull-up banner is permitted per sponsor, placed in the presentation room.
(b) Banner size must not exceed 2m in height by 85cm in width.
(c) No other promotional materials, including gifts, samples and displays, are permitted without prior approval from APB.
11.6 Cancellation and Refunds
If cancellation is required, APB must be notified as soon as possible. Refunds or credits are based on the notice given before the event, as follows. For the APB Summit, this scale applies unless your sponsorship agreement says otherwise.
(a) 180 days or more: 80% refund or credit.
(b) 90 to 179 days: 50% refund or credit.
(c) 30 to 89 days: 25% refund or credit.
(d) 14 to 29 days: 5% refund or credit.
(e) Fewer than 14 days: no refund or credit.
These terms apply to printed products we post to you, such as books and printed reports.
12.1 Shipping and Delivery
(a) Printed products are posted to the address you give at checkout. The shipping and handling fee is shown before you pay.
(b) Delivery times vary by destination. We will give you an estimated delivery time when you order and let you know if it changes.
(c) Please check your address is correct. Orders returned to us because the address given was incorrect will need postage paid again to resend.
(d) If your order arrives damaged or does not arrive, contact us and we will, at your choice, send a replacement or refund you, including the shipping fee.
(e) For orders delivered outside Australia, any import duties, taxes or fees charged by the destination country are payable by you.
12.2 Refunds
Your rights under the Australian Consumer Law are set out under "Your rights under consumer law" above. Where a product page offers its own guarantee, that guarantee applies as well.
13.1 Your agreement
(a) Your agreement for one-to-one coaching or Elite Mentoring is made up of the quote you accept and these terms. The quote sets out the program, the price, the payment schedule and any start date or term, and on those points it applies over these terms.
(b) Your agreement starts on the day your first payment is made, or on the start date stated in your quote if there is one.
(c) Your quote and these terms are the entire agreement between you and APB for the program, and replace any earlier discussions about it.
13.2 How the program runs
(a) Our coaches attend training and take breaks, for example over Christmas and New Year. Sessions are scheduled around those times so that 52 weeks of program material are covered in 48 weeks of coaching sessions.
(b) The program cannot be paused, and there is no provision for extended leave.
(c) Coaching is paid in advance. If a payment is overdue, you will not be able to attend coaching sessions or Masterminds, or book meetings with your coach, until it is paid.
(d) The program is an exchange of training, systems and processes, not of money for time.
13.3 Term, renewal and cancellation
(a) A 12-month one-to-one coaching agreement and an Elite Mentoring agreement each start with a 12-month term. At the end of that term the agreement renews automatically and continues until you give at least 30 days' written notice to cancel. We will remind you before it renews.
(b) Your notice takes effect at the next natural end point after the 30 days: the end of the 12-month term if you give notice during it, and otherwise the end of the billing month. Payments continue until then.
(c) If you accept a renewal quote for a further 12-month term, paragraphs (a) and (b) apply to that term in the same way.
(d) A month-to-month one-to-one coaching agreement continues until you give at least 30 days' written notice to cancel. It then ends at the end of the billing month in which the notice period ends, and payments continue until then.
(e) Your final month of coaching or mentoring is used to set clear direction on what to keep working on.
13.4 Elite Mentoring timeframe
